Green space in Hamilton

Council allows fires to be lit in the open air subject to conditions in the Hamilton City Fire Prevention Bylaw 1993.

The bylaw requires that you:

  • Maintain adequate supervision of the fire
  • Ensure smoke is only emitted to such an extent that it is not a nuisance.
  • Ensure that no person or property is endangered.
  • Take adequate precautions to contain the fire.

It is recommended that you:

  • Have on hand adequate means to extinguish the fire, e.g., water, fire extinguisher.
  • Do not light fires in windy conditions.
  • Ensure all ashes are fully extinguished on completion of burning.
  • Ensure the fire is a safe distance from any buildings and neighbouring property.
  • Do not light fires on peat land, which causes underground fires.

Failure to follow these conditions may result in charges being incurred.

During summer months Council may ban open fires. Notice of any fire ban will be published by way of Public Notice.
