Objective

To provide administrative guidelines under the Fencing Act 1978 and specify areas in which the Council will go beyond those obligations.

Policy

  1. Council will deal with issues concerning fencing between Council and its neighbours in terms of the principles and through the procedures set out in the Fencing Act 1978.

  2. The Parks & Gardens Manager will apply the Fencing Act principles and procedures to the boundaries of recreation reserves and parks, as well as to Council-owned Esplanade Reserves (as defined in Section 2 of the Resource Management Act 1991).

  3. The Water and Waste Services Manager will apply the Fencing Act principles and procedures to the boundaries of water and drainage reserves.

  4. This policy will be administered according to guidelines outlined in a public information document. This document may be revised by staff from time to time, so long as the revisions are in accordance with the Fencing Act 1978 and this policy.

  5. The Fencing Act does not apply to the boundaries of roads, and Council will not contribute towards the fencing of road boundaries. However, Council may contribute towards the cost of fencing walkways/accessways (as defined in Section 43 of the Transit New Zealand Act 1989), as set out below:

    1. The Chairperson of the Transport Committee and the General Manager Works & Services have joint delegated authority by Council to contribute to the fencing of walkways/accessways where social problems occur (as evidenced by complaints to the NZ Police), and where the existing fence provides inadequate security for the resident,

    2. The financial contribution by Council will be 50% of the cost of a standard 1.8m high, 3 rail, solid timber paling fence, with the market value of such a fence re-assessed every 3 years, payable upon completion of the fence.
